Terms of Service

1. Introductory provisions
These Terms of Service (the "Terms") govern the rights and obligations between the operator of the Service and a user (customer) when using the website buttonprintmaker.com (the "Service" or the "Website") and when entering into contracts for the supply of digital content or digital services via the Website.
The operator of the Service is:

(the "Operator" or "we")
Matters not regulated by these Terms are governed in particular by Act No. 89/2012 Coll., the Civil Code, Act No. 634/1992 Coll., on Consumer Protection, and related legislation as amended.
2. Description of the Service
ButtonPrintMaker.com is an online editor for designing print sheets of pin buttons and magnets. Using the editor, a user can:
- create their own designs and lay them out on a print sheet (with automatic layout calculation, trim lines and bleed);
- work with sizes 20, 25, 32 and 58 mm (further sizes may be added);
- export the result as a printable PDF (300 DPI) in A4 or Letter format;
- save work-in-progress projects.
The editor and the design process run directly in the user's browser.
The Service is entirely digital. The Operator does not manufacture, deliver or ship any physical goods (no buttons, no magnets); the actual printing and production are arranged by the customer themselves or by a printing house of their choice.
2.1 Plans and pricing
The current price list is always available on the /pricing page. The following plans are available:

All paid plans include: full access to the editor, all sizes and formats, and an unlimited number of watermark-free PDFs generated for the duration of the plan.
After the 24-hour access expires, or after a subscription is cancelled or unpaid, the Free version remains available (PDFs with the watermark). PDFs already generated and downloaded by the customer remain valid and usable.
3. User account
- A user account registered with an e-mail address is required to use paid plans, store projects and manage the subscription.
- The user must provide accurate and truthful information and update it in the event of changes.
- The user must protect the access credentials to the account. The Operator is not liable for misuse of the account caused by a breach of this obligation.
- The account may be used by a person aged 18 or over. Younger persons may use the Service only with the consent of their legal representative.
- The Operator may terminate an account, in particular for violation of the Terms, long-term inactivity, or at the user's request. Before deleting your account, we recommend cancelling any active subscription.
4. Order and conclusion of the contract
- The customer selects the desired plan on the /pricing page and clicks to order.
- After entering payment and billing information (via the Stripe payment gateway), the customer submits the order.
- Prices shown are inclusive of VAT unless stated otherwise.
- The contract is concluded once the order is confirmed and the payment is successfully processed. The customer is immediately granted access to the paid mode ("Clean printing").
- The Operator reserves the right to refuse or cancel an order if it:
- contains obviously erroneous information or pricing;
- the project content is in conflict with Section 7 (prohibited content);
- there is suspicion of fraudulent activity or abuse of the Service.
5. Price, payment and access duration
- Payments are processed via the Stripe payment gateway (credit/debit cards, Apple Pay, Google Pay, etc.). We do not store card data.
- The "24 Hours" plan is a one-off payment; the "Clean printing" access is active for 24 hours from successful payment.
- The "Monthly" plan is automatically renewed every 30 days (or per the Stripe billing cycle) until the user cancels.
- The "Yearly" plan is automatically renewed every 12 months until the user cancels.
- A subscription can be cancelled at any time from the account management page (or by e-mail to info@swingingdogs.com); the cancellation takes effect at the end of the current paid period – access continues until then, and pro-rata refunds are not provided.
- The tax invoice will be sent to the customer by e-mail or made available in the account.
6. Consent to immediate performance and loss of the right to withdraw
The subject of the contract is the supply of digital content not delivered on a tangible medium or a digital service (access to "Clean printing" under the 24-hour, monthly or yearly plan).
By submitting a paid order and confirming the corresponding consent at checkout, the consumer:
- expressly consents to the Operator beginning performance (granting access to the watermark-free mode) immediately, before the 14-day withdrawal period expires;
- acknowledges that, in accordance with Section 1837(l) of the Czech Civil Code, they thereby lose the right to withdraw from a contract for the supply of digital content not delivered on a tangible medium, or for a digital service whose performance has begun with their prior express consent.
If the consumer does not give this consent, the paid mode will not be granted and the amount paid will be refunded.
Exception in case of technical failure: If, for technical reasons, the paid mode cannot be made available (e.g. repeated server-side error) and the defect is not remedied within a reasonable period, the consumer is entitled to withdraw from the contract and request a refund.
Subscription cancellation under Section 5 above is not a withdrawal in the meaning of the statutory withdrawal period, but a termination of further renewals for the future.
7. Customer-created content
The customer is responsible for ensuring that any content uploaded and created by them (designs, logos, photos, text, etc.):
- does not infringe the rights of third parties, in particular copyright, trade marks and personality rights;
- does not violate any laws (e.g. content promoting violence, hatred, terrorism or child sexual abuse material);
- is not offensive, defamatory or otherwise contrary to good morals.
The Operator is entitled to refuse a project or order, or to suspend the account, if the uploaded content does not comply with these Terms. The customer bears full responsibility for any damage caused by a breach of this obligation and undertakes to indemnify the Operator against all third-party claims arising from such breach.
The Operator does not actively monitor content you upload to the editor; responsibility for its legality and origin lies with the customer.
By uploading content, the customer grants the Operator a non-exclusive, royalty-free licence to use the content solely to the extent necessary to operate the Service (storing the project, displaying it in the editor, generating the PDF).
8. Intellectual property
- All rights to the Website, the editor, templates, fonts, illustrations and other elements of the Service belong to the Operator or its licensors.
- After payment and for the duration of the paid plan, the customer may use the watermark-free PDF generated by the Service for personal and commercial purposes in connection with printing buttons and magnets based on their design, provided that the underlying materials they used are not in breach of these Terms or third-party rights. PDFs already downloaded without watermark remain available to the user even after the paid access expires.
- The customer must not reverse-engineer the Service, copy its source code, replicate its features, create derivative works or develop a competing service through reverse engineering.
- The customer must not remove or obscure the watermark from the Free version other than by lawful payment under Section 5.
9. Complaints and liability for defects of digital content / service
- The Operator is liable for the digital content (the PDF) and the digital service ("Clean printing" under the plan) being in conformity with the contract upon delivery, in accordance with Sections 2389b et seq. of the Czech Civil Code.
- Submit complaints by e-mail to info@swingingdogs.com without undue delay after discovering the defect. Please attach the order number / account e-mail, a description of the issue and, where applicable, a screenshot.
- The Operator will respond to a complaint within 30 days of its submission.
- An accepted complaint is typically handled by remedying the defect (e.g. re-enabling access), a discount or a refund.
10. Service availability and limitation of liability
- The Service is provided "as is". The Operator does not guarantee uninterrupted availability of the Website and is not liable for outages caused by third parties (hosting provider, the Convex.dev database platform, the Stripe payment gateway).
- The Operator does not guarantee that a generated PDF will be printed by any specific printer in exactly the expected colours or sizes – the printed result depends on the printing equipment and materials chosen and provided by the customer. We recommend a test print before printing larger quantities.
- To the extent permitted by law, the Operator's total liability for damages related to an order is limited to the amount paid for the relevant plan in the previous 12 months.
- Nothing in these Terms limits any statutory consumer rights.
11. Prohibited use of the Service
The customer undertakes:
- not to use the Service for any unlawful, fraudulent or harmful activity;
- not to use the Service to send unsolicited bulk communications;
- not to circumvent security measures or technical measures protecting the watermark or the paid access;
- not to perform DoS attacks or otherwise disrupt the Service;
- not to attempt to gain unauthorised access to other users' accounts or to the Operator's systems;
- not to use automated tools (bots, scrapers) to generate PDFs or to load the infrastructure beyond ordinary use;
- not to share paid access with an unlimited number of additional persons; a paid plan is intended for a single user, unless a team option is explicitly offered.
In case of breach, the Operator may block the account, delete projects, cancel the subscription and/or refuse the order.
12. Personal data protection
The processing of personal data is governed by a separate Privacy Policy, which forms an integral part of these Terms.
13. Out-of-court dispute resolution
Consumers have the right to out-of-court resolution of consumer disputes. The competent body is the Czech Trade Inspection Authority (www.coi.cz). The EU Online Dispute Resolution platform is also available at https://ec.europa.eu/consumers/odr/.
14. Governing law and jurisdiction
These Terms are governed by the law of the Czech Republic. Any disputes shall be decided by the competent courts of the Czech Republic, unless mandatory legislation provides otherwise.
15. Changes to the Terms
The Operator may amend these Terms at any time. For one-off contracts already concluded, the version of the Terms in effect at the time the order was submitted shall apply. For ongoing subscriptions, we will inform you of any material change by e-mail or in-app with a reasonable notice period; if you do not agree with the change, you have the right to cancel the subscription.
